Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (whether personally or on behalf of an entity) and Patwary Software, operated by Md Zahid Hasan Patwary(“we”, “us”, or “our”), concerning your access to and use of our web applications, websites, and associated services hosted at zahidp.comand its subdomains (collectively, the “Services”).

By accessing, browsing, registering for, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of all our Services.

2. Description of Service

Patwary Software provides focused, modern web applications built and maintained by Md Zahid Hasan Patwary. Our portfolio of software includes, but is not limited to:

• Zahid Finance: A personal finance, lending, ledger, and net worth tracking application.
• Scholar Quest: An academic and higher-education scholarship research tool.
• Orbit: An operational task workspace and collaboration platform.
• Dhakaiya Bites POS: An offline-first restaurant sales, order, and billing management software.

We reserve the right to introduce new software, enhance existing features, or sunset services in accordance with Section 8 of these Terms.

3. User Accounts & Responsibilities

To access certain features of our applications, you may be required to create an account or sign in using a supported third-party identity provider. By creating an account, you represent and warrant that:

• You are at least 13 years of age.
• All registration information you provide is true, accurate, current, and complete.
• You will maintain the security and confidentiality of your login sessions.
• You are entirely responsible for all activities that occur under your account.
• You will immediately notify us of any unauthorized use or security breach of your account.

4. Third-Party Sign-In & Google OAuth

Our web applications offer user authentication via “Sign in with Google”. When you use Google Sign-In, you grant us permission to access your basic Google profile information (name, email address, profile photo) solely to establish and authenticate your account identity.

Your use of Google Sign-In is also subject to Google’s Terms of Service and Google’s Privacy Policy. Patwary Software complies with the Google API Services User Data Policy, including the Limited Use requirements.

5. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in accordance with these Terms. You strictly agree NOT to:

• Use the Services in any way that violates any applicable national, regional, or international law or regulation.
• Attempt to probe, scan, or test the vulnerability of any system, network, or authentication layer without prior written authorization.
• Circumvent, disable, or tamper with security-related features, database row-level security (RLS), or authentication tokens.
• Reverse-engineer, decompile, disassemble, or extract the source code of our backend software or proprietary algorithms.
• Engage in unauthorized automated scraping, harvesting, or bot-driven extraction of data from our platforms.
• Transmit viruses, trojans, worms, logic bombs, or any malicious material designed to interrupt, destroy, or limit the functionality of the Services.
• Interfere with or disrupt the integrity or performance of the Services or server networks.

6. User Content & Data Ownership

You retain 100% ownership of the data you enter.We claim no ownership rights over any financial figures, transaction records, scholarship notes, menu configurations, inventory data, or other information you submit into our applications (“User Content”).

By inputting User Content into the Services, you grant Patwary Software a worldwide, non-exclusive, royalty-free license solely to host, store, transfer, display, and process your User Content as technically required to provide the Services to you.

We do not sell, publicize, or use your private User Content for marketing, nor do we share it with third-party advertising networks.

7. Intellectual Property Rights

Excluding your private User Content, all content, features, code, design, software, graphics, branding, UI components, documentation, and logos associated with Patwary Software are the exclusive property of Md Zahid Hasan Patwary and are protected by copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes in accordance with these Terms.

8. Service Modifications & Availability

We continuously refine and improve our web applications. As a result, we may modify, suspend, or discontinue any feature, tool, or aspect of the Services at any time. While we strive for 99.9% uptime, we do not guarantee that the Services will be uninterrupted, error-free, or entirely bug-free at all times. Scheduled maintenance and third-party cloud provider outages (e.g., Supabase or Vercel maintenance) may temporarily affect service availability.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PATWARY SOFTWARE, MD ZAHID HASAN PATWARY, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE TOTAL AMOUNT PAID BY YOU TO US (IF ANY) DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless Patwary Software and Md Zahid Hasan Patwary from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with your breach of these Terms, your User Content, or your misuse of the Services.

12. Termination & Account Cancellation

These Terms remain in effect while you access or use our Services. You may terminate your agreement and account at any time simply by ceasing use of the Services and requesting account deletion by emailing mdzahidhasanpatwary@gmail.com.

We reserve the right to suspend or terminate your access to our Services at our sole discretion, without notice, if you violate any provision of these Terms or engage in abusive conduct. Upon termination, your right to use the Services immediately ceases, and your data will be purged in accordance with our Privacy Policy.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. When modifications occur, we will update the “Effective & Last Updated” date at the top of this page. Continued use of our Services following any modifications constitutes your binding acceptance of the updated Terms.

14. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Bangladesh, without giving effect to any principles of conflict of laws.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the competent courts located in Dhaka, Bangladesh, and you irrevocably submit to the exclusive jurisdiction of such courts.
